Important: PrintaBalls mainly sells goods made to the customer’s specifications or clearly personalised.
For such products, the statutory right of withdrawal normally applicable to distance purchases does not apply.
This does not affect the customer’s statutory rights where a product is defective or does not conform to the sales contract.

2. Scope and applicable consumer rights

These Terms & Conditions govern purchases made through Printaballs.com and, where applicable,
its localised or language-specific versions.

By placing an order, the customer confirms that they have had the opportunity to read these Terms
before completing the purchase.

Nothing in these Terms excludes or limits mandatory rights granted to consumers by applicable
Italian or European Union law.

Where a customer purchases for purposes related to a trade, business, craft or profession,
consumer-specific protections apply only where required by law.

3. Personalised and made-to-order products

PrintaBalls specialises in personalised and made-to-order products, including customised tennis balls,
padel balls, golf balls, stickers and other personalised or printed sports-related products and accessories.

A product is considered personalised when it is manufactured, printed, configured or modified according
to artwork, text, logos, colours, quantities, product options or other specifications selected or supplied
by the customer.

Personalised products are manufactured specifically for the individual order and normally cannot be
resold to another customer.

4. Product representation and manufacturing tolerances

Product photographs, digital previews, mock-ups and on-screen colours are intended to provide a reasonable
representation of the finished product.

Exact reproduction cannot always be guaranteed because screens, inks, printing technologies, ball surfaces,
felt, rubber, coatings, materials, product batches and manufacturing processes may differ.

Minor variations in colour, print density, positioning, dimensions, alignment, texture, surface finish,
shape or appearance that are compatible with the selected product and production process do not in
themselves constitute a lack of conformity.

Balls manufactured by third-party brands may also have normal manufacturing tolerances and may include
original manufacturer markings, logos, seams, textures or other surface characteristics.

5. Special characteristics of customised sports balls

Tennis, padel and golf balls are functional sporting products manufactured primarily for use in their
respective sports. Their surfaces may include felt, rubber, synthetic materials, coatings, dimples,
seams, manufacturer logos or other characteristics that affect how a graphic can be printed.

Because printing is applied to a curved and, in some cases, textured or flexible surface, minor variations
in the position, shape, sharpness, density or dimensions of the printed image may occur.

A design displayed as perfectly flat or circular in the online designer may appear slightly different
when physically applied to the curved surface of a ball.

Where a branded ball is used as the base product, the manufacturer’s original logo, markings or other
identifying elements may remain visible unless the product description expressly states otherwise.

Normal manufacturing variations in the base balls, including variations in felt, seams, surface texture,
dimensions, pressure, weight, rebound or finish within the tolerances applicable to the relevant product,
do not in themselves constitute a printing defect or lack of conformity.

6. Durability of printing and use of customised balls

Printed sports balls are functional objects subject to friction, impact, compression, abrasion, contact
with rackets, clubs, courts, ground surfaces and other objects during normal use.

The customised printed area may therefore show wear, scratching, fading, abrasion, cracking or partial
loss of print over time, particularly when the product is actively used for sport.

Normal deterioration of the printed area caused by use does not constitute a production defect.

The durability of the customisation may vary depending on the type of ball, surface, printing technology,
frequency and intensity of use, playing surface, storage conditions and environmental factors.

Unless expressly stated otherwise on the relevant product page, no specific duration of the printed
decoration during active sporting use is guaranteed.

7. Artwork supplied by the customer

The customer is responsible for checking the accuracy, quality, spelling, orientation, resolution,
dimensions, colours and content of artwork, text, logos and other files supplied for production.

Very small text, thin lines, low-resolution images, transparencies, gradients, fine details or colours
close to the colour of the underlying product may not reproduce exactly as they appear on screen.

PrintaBalls may contact the customer where a file presents obvious technical issues, but is not required
to identify every possible design, resolution or print limitation.

Where a digital proof, mock-up, designer preview or other preview is provided, production may be based
on that version.

The preview is intended primarily to show the selected content, approximate position, size and proportions.
It is not a colour-calibrated contract proof and cannot reproduce the exact physical characteristics or
curvature of the finished product unless expressly agreed otherwise in writing.

8. Customer responsibility for intellectual property

The customer confirms that they own, or have the necessary permission or legal right to use, all artwork,
photographs, logos, trademarks, text, designs and other content submitted to PrintaBalls.

By submitting such content, the customer authorises PrintaBalls to reproduce and process it solely to the
extent necessary to fulfil the order and provide related services.

The customer must not submit unlawful content or content that infringes third-party copyright, trademarks,
image rights or other intellectual property rights.

PrintaBalls may refuse or suspend production where submitted content appears manifestly unlawful,
infringing or otherwise inappropriate for production.

9. Orders and acceptance

An order submitted through the website constitutes an offer to purchase.
The order is accepted when PrintaBalls confirms it, begins preparation or production,
or otherwise communicates acceptance to the customer.

PrintaBalls may contact the customer if artwork, specifications, stock availability, shipping details
or other information is incomplete or requires clarification.

Production and delivery times may be suspended while awaiting information or a reply from the customer.

PrintaBalls may refuse or cancel an order where fulfilment is impossible, unlawful, technically
impracticable, affected by an obvious pricing or website error, or where information necessary for
production is not supplied.

Where an order is cancelled by PrintaBalls and payment has already been received, amounts that must be
refunded will be returned using an appropriate payment method.

10. Prices and payment

Prices displayed on the website are those applicable when the order is placed.
Applicable taxes and shipping charges are displayed during checkout according to the destination,
applicable tax rules and customer status.

Any promotional price, discount or special offer applies only under the conditions and for the period
indicated in the relevant promotion.

For shipments to destinations where import formalities apply, customs duties, import VAT,
brokerage fees and other charges imposed by destination authorities or carriers may be payable
by the recipient unless expressly stated otherwise during checkout.

Available payment methods are those displayed during checkout.

11. Production times

Production times displayed on product pages, during checkout or elsewhere on the website are estimates
unless a specific deadline has been expressly accepted by PrintaBalls in writing.

Production times may vary depending on product type, quantity, artwork, availability of the selected
base products, supplier availability, production workload, public holidays, seasonal closures and
circumstances beyond PrintaBalls’s reasonable control.

Customers ordering products for a specific tournament, event, promotion, birthday, competition or other
deadline should contact PrintaBalls before ordering if delivery by that date is essential.

An estimated production, dispatch or delivery date is not a guaranteed delivery date unless expressly
confirmed as such in writing.

12. Shipping and delivery

Orders are shipped to the delivery address provided by the customer.
The customer is responsible for providing complete and accurate delivery information and for ensuring
that the recipient can accept delivery.

Delivery estimates provided by PrintaBalls or by a carrier are indicative unless a guaranteed delivery
service has expressly been purchased and confirmed.

Delays caused by carriers, customs authorities, incorrect or incomplete addresses, failed delivery attempts,
force majeure or other circumstances outside PrintaBalls’s reasonable control may affect delivery times.

Customers should inspect parcels upon delivery and promptly notify PrintaBalls of visible transport damage,
missing items or apparent problems, preferably supplying photographs of the external packaging,
internal packaging and products.

This request to promptly inspect the shipment does not limit statutory consumer rights.

13. Right of withdrawal for personalised products

The statutory right of withdrawal applicable to many distance purchases does not apply to goods made
to the consumer’s specifications or clearly personalised, as provided by applicable consumer law.

Accordingly, products customised using the customer’s artwork, logo, text, images, colours,
configuration or other individual specifications cannot normally be returned simply because the customer
changes their mind, no longer needs the products, ordered the wrong quantity, or dislikes a characteristic
that conforms to the product description and agreed specifications.

This exclusion from the right of withdrawal applies even where production can be completed quickly
after the order is placed.

This exclusion does not affect the customer’s statutory rights where the goods are
defective or otherwise non-conforming.

14. Withdrawal for eligible non-personalised products

Where a consumer purchases a non-personalised product for which the statutory right of withdrawal applies,
the consumer may exercise that right within the period provided by applicable law.

The consumer must inform PrintaBalls of the decision to withdraw by an unequivocal statement within
the applicable legal period and return the goods within the applicable return period.

The direct cost of returning goods following a statutory withdrawal is borne by the customer,
unless PrintaBalls expressly agrees to bear it or applicable law provides otherwise.

We recommend using a tracked shipping service.

The customer may be responsible for any diminished value resulting from handling beyond what is necessary
to establish the nature, characteristics and functioning of the goods, to the extent provided by law.

15. Voluntary and goodwill returns

PrintaBalls may, at its discretion, agree to accept a return even where no statutory right of withdrawal
exists, including personalised goods that are not defective or non-conforming.

Such acceptance is a voluntary commercial gesture and does not create a general right to return
personalised products.

Unless PrintaBalls expressly agrees otherwise in writing, the customer is responsible for
arranging and paying all return shipping costs for a voluntary or goodwill return.

PrintaBalls does not provide a prepaid return label for such returns unless expressly agreed.
A tracked shipping service is strongly recommended.

The customer remains responsible for the return parcel until it is delivered to PrintaBalls.

Original outbound shipping charges are not automatically refundable in a voluntary return and will be
handled according to the specific agreement made with the customer and any mandatory legal requirements.

Products should not be returned before contacting customer service and receiving return instructions.

16. Legal guarantee of conformity

Consumers benefit from the legal guarantee of conformity provided by applicable consumer law.
The seller is responsible for lack of conformity under the conditions and within the periods established by law.

If a product appears defective or non-conforming, the customer should contact

and provide the order number, a description of the problem and, where reasonably possible,
photographs or video that allow PrintaBalls to assess the issue.

Where a lack of conformity is established, the consumer is entitled to the remedies provided by
applicable law, which may include repair or replacement and, where the legal requirements are met,
price reduction or termination of the contract/refund.

Statutory remedies for a confirmed lack of conformity are provided without charge to the consumer.

Where PrintaBalls requires a defective or non-conforming product to be returned in connection with a
statutory guarantee claim, the necessary return costs will be borne by PrintaBalls as required by law.

Customers should not send allegedly defective goods back before receiving return instructions,
because photographic or video evidence, troubleshooting, replacement or another solution may make
a physical return unnecessary.

17. Assessment of complaints and non-defect situations

Before authorising a remedy, PrintaBalls may reasonably assess whether the reported issue is a production
defect, transport damage, normal wear, an artwork-related limitation, a characteristic of the selected
ball or printing method, a manufacturing tolerance of the base product, incorrect use or another circumstance.

A difference in colour rendition, ink density, print position, print dimensions, texture or appearance
is not automatically a defect where it is inherent in or reasonably related to the curved, textured,
felted or otherwise non-flat surface of the selected product and the finished product otherwise conforms
to the order.

Minor differences between separate balls within the same order may occur as a normal consequence of the
printing and manufacturing processes and do not in themselves constitute a lack of conformity.

Normal wear occurring after use, including abrasion or deterioration of the printed surface caused by
sporting use, impact or friction, does not constitute a lack of conformity unless the circumstances
indicate an underlying defect that existed at delivery.

18. Replacement products

Where PrintaBalls agrees to remake or replace a product, the replacement will normally be produced
according to the original order specifications.

Any requested change of product, brand, quantity, artwork, colour or configuration is subject to
availability and technical feasibility and must be expressly agreed by PrintaBalls.

A voluntary replacement, discount or goodwill gesture does not constitute an admission that the
original product was legally non-conforming.

19. Cancellations and changes after ordering

Personalised products may enter preparation or production shortly after an order is placed.
Requests to cancel or change an order are therefore not guaranteed.

If cancellation or modification is requested before personalised production has started,
PrintaBalls will make reasonable efforts to accommodate the request.

Once file preparation, printing or production has started, cancellation or changes may be impossible
or may involve costs already incurred, subject always to mandatory consumer rights.

20. Incorrect customer information

The customer is responsible for the accuracy of names, delivery addresses, email addresses,
billing and tax information, artwork, text, product selections, quantities and other information
supplied when ordering.

PrintaBalls is not responsible for errors in the finished personalised product that reproduce
incorrect information or artwork supplied or approved by the customer.

Additional shipping or production costs caused by incorrect or incomplete information supplied by
the customer may be charged to the customer to the extent permitted by law.

21. Intellectual property and website content

Unless otherwise stated, website content, graphics, text, photographs, layouts, software,
trademarks and other materials belonging to PrintaBalls or Tipografia FB s.n.c. are protected by
applicable intellectual property laws and may not be reproduced or commercially used without permission.

Customer-provided artwork remains the property of its respective owner.
By submitting artwork, the customer grants PrintaBalls the limited rights necessary to review files,
process the order, manufacture the products and provide related customer service.

22. Privacy

Personal data is processed in accordance with our current
Privacy & Cookie Policy.

23. Liability and force majeure

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

Subject to mandatory consumer rights, PrintaBalls is not responsible for failure or delay caused by
circumstances beyond its reasonable control, including carrier disruptions, customs delays,
natural events, fires, strikes, infrastructure outages, government measures, supply interruptions,
shortages of third-party base products or comparable events.

24. Governing law and disputes

These Terms are governed by Italian law, without depriving consumers resident in another country
of mandatory protections applicable to them under European Union rules or other mandatory
consumer-protection rules.

Consumers may have access to applicable alternative dispute resolution (ADR) procedures.
Customers are encouraged to contact PrintaBalls customer service first so that an attempt can be
made to resolve any dispute directly.

For disputes involving consumers, jurisdiction is determined by mandatory consumer-protection rules.

For transactions with business or professional customers, jurisdiction shall be determined according
to applicable law and any valid agreement between the parties.

25. Changes to these Terms

PrintaBalls may update these Terms & Conditions from time to time.

The version applicable to an order is the version made available at the time the order is placed,
unless a later change is required by mandatory law or is expressly accepted by the customer.
